NearBy

Your circle, your choice

Privacy Policy

The short version

NearBy helps invited friends notice when they are close. We use Clerk for account sign-in, Apple and RevenueCat for Near Pro subscriptions, and device permissions for location and notifications. In the current version, location and circle settings are used locally on your device; NearBy does not upload your GPS coordinates to its servers.

1. Information we handle

Depending on how you use NearBy, the app may handle:

  • Account information: your email address, Clerk account identifier, name, username, and optional profile photo. This information is used to sign you in, identify your account, and show your profile to people you invite.
  • Circle and settings information: invited friend names and profile details available to the app, invite-link details, alert radius, and whether nearby alerts are enabled. The current version saves this app state in local storage on your device.
  • Location information: your device location when you grant permission and enable nearby alerts. NearBy uses it to support the nearby experience and does not currently transmit GPS coordinates to NearBy servers.
  • Notification information: your notification permission choice and information needed by the operating system to schedule local alerts. The current version uses local device notifications rather than a remote push-notification service.
  • Subscription information: subscription status, entitlement status, product and price information, and transaction or receipt information processed by Apple and RevenueCat when you buy or restore Near Pro.
  • Support information: information you choose to include when you contact us, such as your email address, device details, and a description of a problem.

2. How we use information

We use information to:

  • provide and maintain the NearBy app and invited-friend flows;
  • authenticate your account and keep it secure;
  • associate your Near Pro access with the correct NearBy account;
  • apply your alert radius and, when enabled, help the device show nearby alerts;
  • respond to support, privacy, and deletion requests; and
  • prevent misuse and comply with legal obligations.

3. Location and notifications

NearBy asks for foreground location permission and, where supported and selected, background location permission so the app can share your current location with your private circle and evaluate alert-radius crossings. Background updates are best effort: iOS and Android may defer, suspend, or prevent them. You can decline or later revoke permission in your device settings. Turning off nearby alerts immediately removes the stored coordinate and marks you offline.

NearBy also asks for notification permission. If you allow it, the app can send a proximity notification to your registered device. Apple, Android, and the operating system control permission and delivery. NearBy does not use silent pushes to promise background execution.

4. Clerk authentication

NearBy uses Clerk to provide authentication and account services. Clerk may process account identifiers, email addresses, profile information, authentication events, and security information on our behalf. When you sign in, NearBy receives the account information needed to provide the app. Clerk's processing is also governed by its own privacy materials.

5. Near Pro subscriptions

Near Pro is an auto-renewable monthly subscription purchased through Apple's App Store. Apple handles payment, billing, taxes, and payment-card information; NearBy does not receive your full payment-card number.

NearBy uses RevenueCat to present the Apple product, validate and restore purchases, and determine whether the Near Pro entitlement is active. RevenueCat receives the NearBy customer identifier associated with your Clerk account and relevant purchase, entitlement, receipt, and product information. RevenueCat does not receive your Apple ID password or payment-card number from NearBy.

Near Pro renews through Apple until cancelled. You can manage or cancel it through your Apple Account subscription settings.

6. Sharing and service providers

We share information only as needed to operate NearBy, provide authentication and subscription functionality, respond to lawful requests, or protect the app and its users. Our current service providers include:

  • Clerk for authentication and account services;
  • RevenueCat for subscription status and purchase restoration; and
  • Apple for App Store distribution, billing, device permissions, and operating-system notifications.

When you share an invite, your device's sharing tools may pass the invite link to the person or service you choose. NearBy does not access your contacts just to create an invite.

7. Retention and deletion

NearBy stores only the latest shared coordinate while tracking is enabled, along with presence and alert-radius state needed to operate the circle. Disabling location, losing a required permission, or missing the server's two-hour presence grace period deletes the stored coordinate and shows you as offline. Presence does not preserve a location history or route.

App state saved locally remains on your device until you remove it, clear the app's data, or uninstall NearBy. Signing out does not automatically erase local app state. Account information held by Clerk and subscription records held by Apple or RevenueCat are retained according to their policies, contractual requirements, and applicable law.

To request access, correction, or deletion of information associated with your NearBy account, email privacy@nearby.app. We may need to verify that the request is yours. We will review the request and coordinate with Clerk or RevenueCat when their systems hold the relevant information. Some records may be retained when required for legal, security, fraud-prevention, or transaction purposes.

Signed-in users can also start an account-deletion request from Settings in the NearBy app. The app clears the saved NearBy circle and settings from that device after the request is confirmed. Account information held by Clerk and subscription records held by RevenueCat or Apple require a separate support review and coordination; submitting the in-app request does not cancel an Apple subscription automatically.

8. Security

We use the security features provided by Clerk, Apple, RevenueCat, and the operating system, and we limit information use to the purposes described here. No method of storage or transmission is completely secure, so we cannot guarantee absolute security.

9. Children

NearBy is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided information to NearBy, contact us so we can review and address it.

10. Changes to this policy

We may update this policy as NearBy changes. When we do, we will update the date at the top of this page. Your continued use of NearBy after an update means the revised policy applies to your use of the app.
